Terms & Conditions

Welcome to Quelez.

These Terms and Conditions (“Terms”) govern the access and use of the Quelez website, applications, queue management platform, appointment scheduling services, visitor flow management systems, digital signage solutions, customer engagement tools, analytics dashboards, and related services (collectively referred to as the “Services”).

By accessing or using the Services, you agree to be bound by these Terms.

1. About Quelez

Quelez provides digital queue management, appointment scheduling, customer journey management, visitor flow optimization, token management, digital display, branch operations support, analytics, and related customer experience solutions for businesses and organizations.

2. Acceptance of Terms

By using the Services, you confirm that:

  • You have read and understood these Terms.
  • You have authority to act on behalf of your organization where applicable.
  • You agree to comply with all applicable laws and regulations.

3. Use of the Platform

Users may use the Services only for legitimate business and customer service purposes.

Users shall not:

  • Use the platform for unlawful activities.
  • Interfere with system operations.
  • Attempt unauthorized access to Quelez infrastructure.
  • Upload malicious software, viruses, or harmful code.
  • Manipulate queue positions, appointment records, or customer data.
  • Circumvent security controls or authentication mechanisms.

Quelez reserves the right to suspend access for misuse.

4. Appointment and Token Services

Where the Services include appointment scheduling or token generation:

  • Token numbers and appointments are generated electronically.
  • Quelez does not guarantee waiting times.
  • Waiting times displayed are estimates only.
  • Service availability depends upon the participating organization’s operational capacity.
  • Quelez shall not be responsible for delays caused by the customer organization, staff shortages, technical disruptions, emergencies, or force majeure events.

5. Customer Responsibilities

Organizations using Quelez agree to:

  • Maintain accurate customer information.
  • Obtain all legally required consents from their customers.
  • Use the Services in compliance with applicable privacy laws.
  • Ensure authorized personnel only access the platform.
  • Protect login credentials and access devices.

Organizations remain solely responsible for the accuracy of information entered into the platform.

6. Visitor and Customer Data

Quelez processes information solely for the purpose of providing queue management and customer experience services.

Such information may include:

  • Name
  • Mobile number
  • Email address
  • Appointment information
  • Branch location
  • Service preferences
  • Visitor identification details where required

Processing of personal data shall be governed by the Quelez Privacy Policy and applicable Indian laws, including the Digital Personal Data Protection Act, 2023.

7. Digital Signage and Display Content

Organizations using Quelez Digital Signage Services remain solely responsible for:

  • Content displayed on screens
  • Announcements
  • Advertisements
  • Customer-facing communications

Quelez does not review or endorse display content and shall not be liable for customer-generated materials.

8. Service Availability

Quelez aims to maintain high service availability but does not guarantee uninterrupted operation.

Services may be temporarily unavailable due to:

  • Scheduled maintenance
  • Security updates
  • Network outages
  • Power interruptions
  • Telecommunications failures
  • Third-party service disruptions

9. Analytics and Reporting

Analytics, dashboards, forecasts, reports, and operational insights provided by Quelez are informational in nature.

While reasonable efforts are made to ensure accuracy, Quelez does not guarantee:

  • Accuracy of forecasts
  • Business outcomes
  • Customer footfall predictions
  • Operational performance improvements

Organizations remain responsible for their own business decisions.

10. Intellectual Property

All software, source code, algorithms, dashboards, reports, designs, trademarks, logos, interfaces, and documentation are the exclusive property of Quelez or its licensors.

No ownership rights are transferred through use of the Services.

11. Third-Party Integrations

The Services may integrate with:

  • SMS gateways
  • WhatsApp services
  • Email providers
  • Calendar systems
  • ERP systems
  • Banking platforms
  • Government platforms

Quelez shall not be responsible for interruptions or failures caused by third-party providers.

12. Fees and Subscriptions

Where Services are provided under subscription or commercial agreements:

  • Fees shall be payable according to executed agreements.
  • Failure to pay may result in suspension or termination of Services.
  • All fees are exclusive of applicable taxes unless stated otherwise.

13. Limitation of Liability

To the maximum extent permitted by law, Quelez shall not be liable for:

  • Queue delays
  • Missed appointments
  • Customer dissatisfaction
  • Loss of business opportunities
  • Revenue loss
  • Data loss caused by customer actions
  • Indirect or consequential damages

Quelez’s total liability shall not exceed the fees paid by the customer during the preceding twelve (12) months.

14. Indemnity

Customers agree to indemnify and hold harmless Quelez, its officers, employees, affiliates, and partners from any claims arising from:

  • Misuse of the Services
  • Violation of applicable laws
  • Unauthorized use of customer data
  • Breach of these Terms
  • Customer-generated content

15. Termination

Quelez may suspend or terminate access:

  • For violation of these Terms
  • For security concerns
  • Upon expiry of subscription agreements
  • When required by law

Termination shall not affect accrued rights and obligations.

16. Confidentiality

Both parties agree to maintain confidentiality of proprietary business information, operational data, technical information, and trade secrets obtained during use of the Services.

17. Force Majeure

Neither party shall be liable for delays or failures caused by events beyond reasonable control including:

  • Natural disasters
  • Pandemic events
  • Cyberattacks
  • Government restrictions
  • Telecommunications failures
  • Internet outages
  • Electrical disruptions

18. Governing Law

These Terms shall be governed by the laws of India.

19. Dispute Resolution

Any dispute arising from these Terms shall first be resolved through mutual discussions.

If unresolved within thirty (30) days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.

The seat of arbitration shall be Kerala, India.

Proceedings shall be conducted in English.

21. Modifications

Quelez reserves the right to modify these Terms at any time.

Updated versions shall be published on the website and become effective upon publication. Continued use of the Services constitutes acceptance of the revised Terms.
